Small Market, LLC d/b/a The Boombox Studio ("Small Market," "we," "us," or "our") understands the importance of privacy, and we want you to make an informed decision about sharing personal information with us when visiting our website and mobile application and using our services. We have prepared this privacy policy ("Privacy Policy") to describe our practices regarding the information we receive and collect from users of (1) our website located at www.theboomboxstudio.com ("Site"), (2) the services offered through our mobile application The Boombox App ("App"), and (3) the services, products, materials and programs offered through the Site and/or the App (“Additional Services”). We will refer to the Site, App, and Additional Services as the "Online Services." The Privacy Policy applies to all visitors, users, and others who access the Online Services.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with the Privacy Policy, do not download the App, create an account ("Account"), or use the Online Services. By downloading the App, creating an Account, or using the Online Services you agree to this Privacy Policy and you consent to our collection, use and disclosure of your personal information as described in this Privacy Policy.

CHILDREN

The Online Services are not directed to children and children are not eligible to use the Online Services. Protecting the privacy of children is very important to us. We do not collect or maintain Personal Information from individuals we actually know are under 13 years of age, and no part of the Online Services is designed to attract individuals under 13 years of age. If we later learn that a user is under 13 years of age, we will take steps to remove that user's Personal Information from our databases and to prevent the user from utilizing the Online Services.

INFORMATION WE COLLECT

Small Market collects your personal information from you only with your knowledge and consent. We collect your name and email address when you sign up to receive our email newsletter or our blog updates.

We also collect non-personally identifiable information from you in order for us to better understand how our website is used. Information about a user’s visit is logged. Usage statistics are gathered in a non-intrusive manner. The log files are private documents and are primarily used by the server administrator for error notification, server administration and to monitor website performance. Occasionally, portions of the log files may be viewed by others for the purpose of server administration, security or when required by law.

Small Market uses the services of two leading Software companies, Vint Incorporated (www.joinvint.com) (“Vint”), and the Rocket Science Group LLC d/b/a MailChimp (www.mailchimp.com) (“MailChimp”), (collectively, “Third Party Service Providers”) for scheduling, registration, order processing, online payments, and email management. Please visit their websites to acquire information about the companies and their privacy policies, which are hereby incorporated to this Privacy Policy by reference. In the event of any dispute arising out of or related to the services made available by Third Party Service Provider, the privacy policies of the Third Party Service Provider will govern with respect to such dispute.

When you make a purchase through Vint, they ask for your name, address, phone number, email address and other personal information necessary to fulfill and track your order. For purposes of billing, you will need to provide your credit card type, number, expiration date and billing address for the card.

Vint also requires you to create an account by providing your email address and designating a unique access password for future access to your account information. Creating this account allows Vint to save your billing information so you won’t have to fill out that information again the next time you make a purchase on their site.

COOKIES

When you use our Online Services, small text files known as “cookies” may be stored on your computer’s hard drive. We customize certain Site page content based on your browser-type or other information provided by our cookie. Small Market does not use cookies to retrieve personal information about you from your computer. If you reject the cookie, you will still be able to browse our site; however, you may not be able to use Vint to purchase classes. This is because cookies are required by the shopping cart to retain the necessary information to process your order.

HOW YOUR INFORMATION IS SHARED

Third Party Service Providers: We may share your information with our third party service providers, such as Vint and MailChimp, and other agents who provide services such as website hosting, data analysis, order fulfillment, information technology and related infrastructure provision, customer service, email delivery, text messaging, credit card or other payment processing, auditing and similar services.

Sharing by You: If you choose to connect our mobile application to a third-party fitness data platform (such as Apple Health, Google Fit, or Fitbit), Vint will share your information with such platform, which may have information practices that are different from ours. You may revoke your consent to such sharing by accessing the settings for the relevant platform. Similarly, if you elect to connect your social media account to your Account, Vint may share your personal information with your friends associated with your social media account and with your social media account provider (which may have different information practices from ours). You may revoke your consent to such sharing by accessing the social media platform’s settings.

Legal Requests or Requirements and to Prevent Harm: We reserve the right to disclose your personal information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process. We may also share personal information when we have a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, or to prevent harm to or protect the rights or property of, Small Market, our clients or others. This may include sharing information with other companies, lawyers, courts, or other government entities.

Transfer in the Event of Sale or Change of Control: If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business or Online Services to a third party, we may transfer your personal information to the new owner.

Other Sharing of Non-Personally Identifiable Information: We may share non-personally identifiable information with third parties for any purpose, except where we are required to do otherwise under applicable law.

OUR MAILING LIST

When you sign up to our email mailing list, we will use your email address to send you newsletters containing information about our business, including but not limited to new schedules, holiday hours, event information, or promotions we are offering. Each newsletter will contain simple instructions on how to unsubscribe (opt-out) from the newsletter list. Each newsletter will also contain a link that will allow you to log in to the email system and change the current data so that you are always in control of the information you provide.

LINKS TO OTHER WEBSITES

We sometimes provide links to other organizations’ websites, including but not limited to Facebook, Instagram, and Twitter. Unless we expressly say otherwise, a link to another website does not mean that we are responsible for, or that we endorse the content or policy of that website. When you provide information at one of those sites, you are subject to that site’s privacy policy. This Privacy Policy may change from time to time. Your continued use of the Online Services after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates. The “Last modified” legend below indicates when this Privacy Policy was last updated.
